1. Introduction
Welcome to Sumcap, a protocol risk scoring dashboard designed to provide transparent and reliable risk assessments for DeFi protocols. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our service. These terms constitute a legally binding agreement between you and Sumcap.
2. User Obligations
As a user of our platform, you agree to use our services in compliance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree not to misuse the platform, including but not limited to: attempting to gain unauthorized access to our systems, interfering with the proper functioning of the platform, or engaging in any activity that could harm our service or other users. You must provide accurate and complete information when submitting protocol data or using our services.
3. Intellectual Property
All content, features, and functionality on the Sumcap platform, including but not limited to text, graphics, logos, icons, images, software code, and data compilations, are the exclusive property of Sumcap or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent. Protocol data you submit remains your property, but you grant us a license to use it for the purposes of operating and improving our platform.
4. Disclaimers
The information and risk scores provided on the Sumcap platform are for informational purposes only and should not be construed as financial, investment, or legal advice. We make no guarantees regarding the accuracy, completeness, or timeliness of the information presented.
The platform is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free. Your use of our platform is at your own risk, and you should conduct your own research and due diligence before making any investment decisions.
5. Limitation of Liability
To the maximum extent permitted by law, Sumcap and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your access to or use of or inability to access or use the platform; (b) any conduct or content of any third party on the platform; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event shall our aggregate liability exceed the amount you paid us, if any, in the past six months.
6. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Sumcap operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts in that jurisdiction. You agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims or disputes.
7. Changes to Terms
We reserve the right to modify or replace these Terms of Service at any time at our sole discretion. If we make material changes, we will provide notice through the platform or by other means as appropriate. Your continued use of the platform after any such changes constitutes your acceptance of the new terms.
